RAVIA, Okla. (AP) _ A former southern Oklahoma mayor could face prosecution despite promises made by city officials.

On Nov. 19 ex-Ravia mayor George Herron told present Mayor Rick Kreger and Water Superintendent Monte Ketchum that he had spent money from the town water and sewer fund while serving as assistnt town clerk and public works trust clerk.

At the time, he agreed to make full restitution, including the cost of an audit to determine how much money was missing. Town officials had said prosecution would be declined if restitution is made.

Herron was immediately relieved of all municipal duties and his resignation was accepted by town trustees at an emergency meeting.

``We won't know until the auditor is finished,'' Kreger said of a dollar amount missing. An estimate of $6,000 to $10,000 lost is ``a good ballpark fiture,'' he said.

Herron could not be immediately reached for comment.

Johnston County Assistant District Attorney Charles Migliorino said his office will decide if the situation warrants an investigation and possible charges despite the promise made by city officials.
