Eufaula - The Oklahoma Court of Criminal Appeals has upheld the convictions and death sentences of a man convicted of killing an elderly McIntosh County couple for a car, two pistols and seventy dollars.
Harold Loyd McElmurry received two death sentences for killing 80-year-old Robert Pendley and his 75-year-old wife, Vivien, at the couple's Lenna home in 1999.
McElmurry was also sentenced to 100 years for robbery with a dangerous weapon and to 20 years for larceny of a motor vehicle. Harold McElmurry testified that he and his wife were on methamphetimine at the time of the killings.
The couple took the Pendley's car and fled to Mexico. They were apprehended when the attempted to cross back into the United States.
They were extradited back to McIntosh after Harold McElmurry confessed to the killings to a Texas Ranger.
