Family and friends of a murdered Oklahoma Highway Patrolman have to wait longer for justice after a judge declares a mistrial.
The 12 jurors couldn't agree whether Kenny Barrett was guilty of murdering Trooper Rocky Eales back in September of 1999. Barrett is charged with shooting Eales after troopers tried to serve a drug warrant. District Attorney Dianne Barker Harrold says 11 jurors voted Barrett guilty of first-degree murder, which could've lead to a death sentence. But one juror believes Barrett acted in self-defense.
Harrold says family and friends of Eales are disappointed by the decision. "They've been going through three years of the grief process and trying to get on with their lives but this case is still there."
Prosecutors will re-try the case with a new jury in early January.
