(Oklahoma City-AP) -- The question of where a lawsuit challenging new smoking rules in the state should be heard goes to the state Supreme Court Tuesday.

The state Department of Health wants the court to overturn a lower court ruling that the lawsuit should be heard in Creek County, where it was filed.

The department says the lawsuit should be moved to Oklahoma County, the seat of state government.

A restaurant and a VFW Post in Sapulpa filed a lawsuit challenging the rules passed by the Health Department and signed by Governor Keating.

A Creek County judge has issued a temporary injunction prohibiting the Health Department from enforcing the new rules until the lawsuit is decided.
