Testimony Begins in Chmura Trial

WAUKESHA, Wis. (AP) â€” The teen-ager who accused Mark Chmura of sexually assaulting her at a party hated the former Green Bay Packers star and lied about the incident, his lawyer told a jury Thursday in opening statements.

Defense attorney Gerald Boyle said the girl, who baby-sat Chmura's children, told different versions of what happened.

``Evidence will show (the girl) hated, hated Mr. Chmura,'' Boyle said. ``She wasn't a normal baby sitter. She told her friends about this hatred.''

The girl, now 18, has accused Chmura of leading her into the bathroom during a post-prom drinking party at a friend's home in April and having sex with her without her consent.

Chmura, 31, could get up to 40 years in prison and $20,000 in fines if convicted.

District Attorney Paul Bucher told the jury that Chmura ``gently guided her in, pulled her in, and then after maybe just 30 seconds or a minute, he's kissing her and then she's on the floor.''

Chmura was a three-time Pro Bowl selection and appeared in two Super Bowls with Green Bay. The Packers cut him in June after he was arrested.

Boyle sought unsuccessfully to have the case thrown out, contending Chmura can't get a fair trial in Wisconsin.

The first witness, a friend of the baby sitter, said the baby sitter told her that she had sex against her will with Chmura.

``She said it was not consensual in any way. She said it hurt,'' the 18-year-old friend testified.

The witness said she pounded on the bathroom door when she heard her friend was in there with Chmura. She said her friend and Chmura were both fully clothed when the door opened, and the girl's hair was mussed.

Questioned by Boyle, the woman agreed that she hadn't told police that her friend's hair was mussed. The woman who testified Thursday has accused the host of the party with sexual assault. Those charges are pending.
