(Oklahoma City-AP) -- Oklahoma County District Attorney Bob Macy has given notice that he intends to appeal a decision that bars him and his assistants from prosecuting Terry Nichols.

A judge ruled on Monday that Macy is too involved in the case against the Oklahoma City bombing conspirator. The judge also says Macy violated ethical rules against pretrial publicity.

Macy is challenging the ruling to the Oklahoma Court of Criminal appeals.

Nichols is serving a life sentence on a federal conviction for conspiring to bomb the federal building.

The state has charged him with 160 counts of first-degree murder.
