(Oklahoma City-AP) -- A petition seeking disciplinary action against a Tulsa County judge has been dismissed. The appellate division of the state Court on the Judiciary threw out a petition against District Judge Gregory K. Frizzell which alleged that Frizzell failed to act in a timely manner on a case before him.
Attorney General Drew Edmondson filed the petition in February. The appellate division says the Council on Judicial Complaints and the trial division of the Court on the Judiciary lack jurisdiction to consider the allegation, which even if true wouldn't call for the judge's removal or compulsory retirement.
The appellate division made the same ruling earlier this month in a case Edmondson filed against Associate District Judge William Mattingly of Osage County. The earlier opinion said the Supreme Court has exclusive jurisdiction for such discipline.
