(Las Vegas-AP) -- A Florida woman has filed suit in Las Vegas to have her late husband's second marriage declared void.

Nancy Fawcett was married to John Fawcett in 1958 and only recently discovered he had married a Las Vegas woman in 1995. He died earlier this month.

Fawcett says she and her husband never divorced. He spent three weeks a month in Nevada after moving his company from Florida to Nevada several years ago.

Her lawyer says the confusion has prevented the first Mrs. Fawcett from claiming his ashes and could affect her ability to obtain assets.

A lawyer for the second wife says she believes John Fawcett was divorced.
