TULSA, Okla. (AP) -- A Tulsa man convicted of injuring his infants on will not face additional charges after the baby died, prosecutors said. Ten-month-old Juan Carlos Chavez died eight months after being beaten by his father, Marco Chavez, officials said.

The baby has been hospitalized since May 8 when he was admitted at 57 days old with a skull fracture, broken ribs and other serious injuries, officials said. Chavez, 37, was sentenced in September to life in prison with the possibility of parole for injuring a child. He told police that he struck the child's chest with his fist and slapped him on the head, according to an affidavit.

The cause and manner of the baby's death was pending at the state Medical Examiner's Office on Thursday. Assistant District Attorney Matt Cyran said Chavez will not be charged in the death if it is determined that Juan died as a direct result of the beatings. "He was already convicted of the other charge for the same set of facts," Cyran said. "There is nothing we can do." The baby's death would be added to Chavez's legal record to be used in eventual consideration of parole, Cyran said.
