WASHINGTON (AP) -- The US Supreme Court said Monday it will consider whether states can tax gasoline that's sold on Indian reservations.
The case under review comes from Kansas where that state taxes non-Indian companies that sell gasoline to an Indian tribe that operates a gas station, casino and convenience store. A federal appeals court ruled the tax violates federal law, which prohibits taxes on companies that sell to tribes unless specifically allowed by Congress.
Oklahoma and 12 other states that have fuel taxes and have Indian lands asked the court to hear Kansas' appeal.
Arguments are to be heard this fall and a ruling is expected in July 2006.
