OKLAHOMA CITY (AP) _ A man who was killed after trying to rob a convenience store here was hit in the back with a bullet as he tried to run away, a court affidavit shows.
Anthony Frederick Rowe, 35, died Dec. 16 at the T&D Convenience Store.
Store owner Trung N. Duong, 49, is being held without bail on a murder complaint in the Oklahoma County jail in connection with the shooting.
Rowe entered the store and stopped in front of a cigarette display, the affidavit shows. He gathered several cartons and then started to run out of the store.
Duong fired three shots from a semi-automatic pistol, one of which hit Rowe in the back, the affidavit states.
Prosecutors haven't formally charged Duong. They filed for an extension on Wednesday.
