OKLAHOMA CITY (AP) _ An appeals court Thursday upheld the conviction and death sentence of Brenda Andrew, who is on Death Row for killing her estranged husband in 2001.
Four of the five judges on the state Court of Criminal Appeals affirmed the conviction. Judge Charles Chapel said based on errors during the trial, he would reverse the conviction and order a new trial.
Judge Arlene Johnson concurred in affirming the conviction but said she would have reversed the sentence and ordered a new sentencing trial.
Andrew, an Oklahoma City resident, was charged with James Pavatt in the murder of Robert Andrew. The two were trying to collect on an $800,000 life insurance policy made in Robert Andrew's name.
They were tried separately.
Pavatt was also convicted of murder and sentenced to death.
