ERIE, Pa. (AP) _ A woman who admitted to swinging her 4-week-old son like a bat to hit her boyfriend, fracturing the infant's skull, has withdrawn her guilty plea.
Chytoria Graham, 27, of Erie, was allowed on Monday to withdraw her plea to charges of aggravated assault and endangering the welfare of a child. She asked for the withdrawal on Friday, the day she was to be sentenced.
Prosecutors said Graham picked up Jarron Troop and swung him at Deangelo Troop, Jarron's father, during a fight. Jarron has since recovered.
But Graham's attorneys said she pleaded guilty because she had been drinking that night and felt responsible for anything that happened to her son. She now remembers the events of Oct. 8 more clearly, they said, and believes Deangelo Troop caused Jarron's injuries.
Graham also didn't understand the five-year minimum sentence required by her March plea bargain because the victim was younger than 13, her attorneys said.
She remains free on $7,500 bail.
District Attorney Brad Foulk said his office will consider appealing.
