OKLAHOMA CITY (AP) -- The state Health Department says it will appeal a judge's ruling that overturns two requirements of tattoo parlors in Oklahoma.

Oklahoma County District Judge Dan Owens threw out one regulation requiring tattoo shops be more than 1,000 feet from a church, school or playground. He also tossed the requirement that shop owners have a $1,000 surety bond.

Health Department attorney Tom Cross says the agency believes the state Supreme Court should ultimately decide the issue.

An attorney for the tattoo shop owners couldn't be immediately reached for comment.
