STILLWATER, Okla. (AP) -- A Payne County judge ruled Friday that former Oklahoma State basketball coach Eddie Sutton had met the terms of the probation he received last year after pleading no contest to aggravated drunken driving.
Special District Judge Michael Stano dismissed the case and expunged it from Sutton's record, according to the county court clerk's office. Sutton, 71, did not appear in court Friday but was not required to do so.
Sutton was charged with misdemeanor aggravated drunken driving, speeding and driving on the wrong side of the road after the February 10, 2006, crash, and pleaded no contest on May 5 after reaching a plea deal with prosecutors. He paid $1,438 in fines and other costs and received a deferred sentence.
Stano said the court would retain jurisdiction on the issue of restitution in the case and set a Nov. 6 hearing to review that issue.
A woman injured in the accident, Teresa Barnard of Perry, filed a legal claim with the state this February seeking more than $125,000. The claim, filed with the state's Department of Central Services, says Barnard incurred nearly $40,000 in medical and injury-related expenses since the accident with Sutton.
By law, the state has 90 days to investigate the claim. If the state denies it, Barnard would have up to six months to file a lawsuit.
