TAHLEQUAH, Okla. (AP) A Cherokee County woman who was convicted of killing her husband and then was granted a new trial has been released on bail.
Pearl Smith was convicted in Cherokee County District Court of second-degree murder and sentenced to 28 years in prison in the June 2003 shooting death of her husband, Tom. At a hearing this week, Smith's bail was reduced to 25-thousand dollars.
The Oklahoma Court of Criminal Appeals granted Smith a new trial in September after ruling her attorney didn't present a battered woman syndrome defense at her original trial.
