OKLAHOMA CITY (AP) The state Health Department has lost in its effort to levy a $5 million penalty against a Tulsa accountant.

The state Supreme Court is upholding a lower court ruling that the department cannot impose penalties on an accountant who falls outside the range of the Nursing Home Care Act.

The Health Department wanted accountant Patrick Walters to pay for allegedly destroying documents and conspiring to hide information about a conspiracy in the administration of some Oklahoma nursing homes.
