OKLAHOMA CITY (AP) _ Eight members of the state Supreme Court are appealing a ruling in an age discrimination lawsuit filed against them by the ninth member.
84-year-old Justice Marian Opala is suing the other eight justices saying they discriminated against him by changing a rule to prevent him from serving as chief justice this year.
A federal judge from Wyoming who was assigned to the case rejected a motion to dismiss the case in May and last moth refused a request to reconsider the decision.
The eight judges are appealing that decision to the Tenth Circuit Court of Appeals in Denver.
The justices argue that Opala doesn't have a federal case against them, and that even if he did they're immune from such a lawsuit.
