MUSKOGEE, Okla. (AP) -- The attorney for a school superintendent who has been charged with a misdemeanor says his client has decided to resign.

Lawyer Richard -O- Carroll says Boynton-Moton Superintendent Steve Henson will accept $37,500 to quit at a board meeting set for today.

School board attorney Brian Drummond wouldn't confirm or deny the settlement.

A due process hearing had been set for today after Henson received notice of possible termination June 30th. On August 2nd, Henson asked a Muskogee County judge to bar the hearing, saying the school board had already decided to fire him.

But Drummond filed to have the case moved to federal court in Muskogee because he says Henson's state filing was based on federal constitutional claims.

The Boynton-Moton board suspended Henson in June after he was charged in McIntosh County District Court with felony injury to a minor child -- his stepdaughter.

He also was charged with two misdemeanors but all three charges were dismissed and a misdemeanor assault and battery charge was filed.
