Appeals court to rule by Monday

OKLAHOMA CITY (AP) The Oklahoma Court of Criminal Appeals says it will rule by noon Monday on the constitutionality of a law used in charging a former Creek County district court judge.

Former Judge Donald Thompson's trial on four felony indecent exposure charges has been slowed by the legal question.

During the investigation of Thompson, officials allegedly found four pornographic images on Thompson's court computer, leading to the misdemeanor charge of misuse of state property.

Thompson's attorneys said in filings this week that the law is unconstitutionally vague.
In papers filed yesterday, the Court of Criminal Appeals ordered prosecutors to respond to the issue by noon today.

No hearing has been scheduled, but the court's filing says it will decided in time to meet the planned resumption of the Thompson's trial Monday afternoon.

A separate appeal by Thompson's attorneys who are seeking to remove Judge C- Allen McCall from the misdemeanor case is due to be heard today.
