Federal Judge Rules Excessive Force Case Against Tulsa Police Can Move Forward

A federal judge has decided 5 of 7 excessive force complaints can move forward in a civil trial.

A man sued the Tulsa Police Department after he says three officers used excessive force on him back in 2017. This stems from an incident when officers say they were searching for a suspect near a barn. The man who owned the property says all the activity was spooking the horse and he was trying to get to his horse when officers stopped him. 

"When he tried to subdue the horse, he got into a verbal altercation with the officers that resulted in him going to the hospital with a fractured elbow, broken eye socket, and two felony charges and two misdemeanor charges," said Morris's attorney Ben Fu with Swab, Stall, Horton and Fu. 

The charges were later dismissed. Court documents say the three Tulsa Police Officers stated:

"The amount of force they used to arrest Morris was objectively reasonable, and they claim that it was Morris who initiated a physical confrontation with police officers."

"This has been a pretty devastating experience for him. He has long been a supporter of police. He maintains to this day he has no problem with police, but he is disturbed by what he saw happen," said Fu. 

Court documents say Morris is also concerned that some use of force complaints can be removed from an officers personnel file over time.

News On 6 reached out to the City of Tulsa, they said they cannot comment on pending litigation.
