A judge has directed the U.S. Marshals to release a man previously charged with 5 counts of rape after the charges were dismissed.

After a Supreme Court ruling, Smith filed to have his state charges dismissed due to him being Choctaw Indian.

Then, federal charges were filed against Smith in the Eastern District of Oklahoma.

However, the charges against Leroy Smith were dropped due to the statute of limitations being expired, officials said on Thursday.
