The man charged with killing Tulsa Police Sergeant, Craig Johnson, is suing District Attorney Steve Kunzweiler to prevent prosecutors from seeking the death penalty.
David Ware is being represented by a private attorney due to a conflict of interest in the public defender's office.
Ware's lawyer said Oklahoma's $25,000 limit for compensation is not enough to cover a death penalty case.
The federal lawsuit claims the state's limit is unconstitutional and wants the death penalty off the table unless the constitutional violations are addressed.
