A federal judge sentences a former Eufaula city councilor to more than three years in prison for killing his passenger after crashing his motorcycle.

Investigators said Dan Kirby crashed his motorcycle in 2022, throwing Sherly Bischel from the bike, who later died.

They said a blood test showed Kirby had alcohol and several drugs in his system at the time of the crash.

A jury found him guilty of involuntary manslaughter.

The judge sentenced him to 41 months in prison.

Kirby is also a former state lawmaker who resigned in 2016 after he was accused of sexually harassing an aide.
