Double jeopardy will keep an Oklahoma inmate from being charged with murder in the death of his quadriplegic roommate.

Marvin Lee Perry is serving a 10-year prison term for assaulting Phillip Martley Jr. Martley died three months later from gunshot-related complications. But Perry's assault conviction precludes him from being prosecuted for homicide.

Double jeopardy prevents individuals from being prosecuted or punished twice for the same offense.
