A McClain County judge will decide whether jurors should hear an alleged confession from a man accused of killing his 10-year-old neighbor.

Kevin Underwood is charged with first-degree murder.  Prosecutors want him to die for the April 2006 death of Jamie Bolin in Purcell.

Prosecutors say the taped confession should be included because Underwood was not coerced and willingly made his admission about Bolin to law enforcement.

Defense attorneys want the confession thrown out.  They argue Underwood's constitutional rights were violated.
