Tulsa police want lawmakers to close a loophole that allows rapists to get a lighter sentence when the victim is drugged.  Basically the way state law is written, first-degree rape doesn't apply when the victim is unconscious.

The issue came up when investigators were looking into accusations a former Saint Francis nurse had raped an unconscious patient.

The District Attorney says he was forced to charge Olayinka Osifeso with second-degree rape.  Osifeso has pleaded not guilty.

The maximum punishment for second-degree rape is 15 years in prison.  But, a charge of first-degree rape carries a maximum sentence of life in prison.
