A mother trying to protect her child says the Department of Human Services has been slow to investigate claims of sex abuse against her child's father.
Now, he's taking her to court for refusing to let him see their son.
Theresa Bagley fears her three-year-old son has been exposed to porn, drugs, and lewd acts while in his father's care. Both DHS and Dibble police are investigating.
"DHS has told me because I am aware of the things, I've been told that if I let him go back, and an incident occurs, I would be charged with failure to protect," Bagley said.
Bagley says it took DHS more than a month to contact witnesses in the case, and DHS failed to show up at the first court hearing.
A DHS spokesperson say they take all reported abuse cases seriously and investigate every claim they get.
