TULSA, Oklahoma -

The medical examiner said a man who died in police custody in Warner earlier this year died from asphyxiation due to physical restraint.

The ME said David Lynch also had meth in his system, cardiovascular disease and evidence a Taser had been used.

The Oklahoma State Bureau of Investigation said Lynch attacked Officer Michael Shamblin and broke his eye bone when he responded to a traffic accident.

Shamblin's attorney, Scott Wood, said he and Lynch struggled for more than ten minutes in a ditch before backup arrived.

Wood said Lynch’s father was at the scene yelling for his son to stop fighting.

According to Wood, Shamblin asked someone to call 911 or he would have to shoot him. He said a witness called 911 and held up the phone so Shamblin could yell instructions.

Wood said help arrived and held Lynch so Shamblin could holster his Taser.

Once Shamblin and the backup officers noticed Lynch was not breathing they called for an ambulance which arrived shortly afterward.

The Muskogee County district attorney said he was waiting on the medical examiner's report before deciding whether to file charges.
