Monday, a Tulsa nurse accused of raping a patient with Alzheimer's left court with an ankle monitor.

The case is coming on two years, and, not only has he yet to make a plea, the defendant, Stephen Reed, showed up two hours late to court.

Reed’s attorney asked for a continuance so he could get his things in order before pleading guilty or not, but Reed said he has other plans.

Allison: "Why do you need a continuance?"
Reed: "It's my father's birthday coming up. My mother just died two years ago."

The former nurse is charged with rape by force and fear, and raping someone with an unsound mind.

He was arrested in March of 2014 - three months after the victim said the sexual assault happened, under Reed's care at the Autumn Leaves Memory Care Center in Tulsa.

An affidavit states Reed admitted to having sex with the 84 year old but said he never forced himself on her and claimed it was consensual.

Allison: "You didn't do the things you're accused of?"
Reed: "No, I didn't."

A News On 6 Investigation revealed Autumn Leaves suspended Reed for three days and brought him back on when the director didn't believe the woman's claims. Autumn Leaves did an internal investigation but did not tell police.

The woman's family is now suing Autumn Leaves and Reed. They won't talk about the charges because of the pending lawsuit, but were in court Monday, hoping he'd make a plea.

Reed: "Anything else?"
Allison: "The victim's family doesn't feel like that's a real reason."
Reed: "I don't know what the deal is."

The prosecutor on the case said he's disappointed Reed didn't plead Monday, but said he's ready for next Monday when he expects Reed will.

Reed's attorney reiterated that the week-long continuance was not so Reed could celebrate his dad's birthday, but so he could get things in order.
