Prosecutors charge Bristow man in connection with assault on teen

SAPULPA, Okla. (AP) -- Creek County prosecutors have charged a convicted sex offender with the sodomy and rape of a 15-year-old Creek County girl, authorities said.

Prosecutors charged Danny Joe Boomershine, 48, on Tuesday with forcible sodomy and rape by instrumentation in connection with a July 25 assault on the teen-ager.

The girl's mother reported the alleged assault to a Creek County sheriff's deputy at the Bristow Police Department on Oct. 10, according to an affidavit.

Taken into custody over the weekend, the Bristow resident is being held in Creek County Jail in lieu of $100,000 bail, Sheriff Larry Fugate said.

Boomershine on Tuesday appeared before Special Judge Russell Miller, who entered innocent pleas on his behalf and set his preliminary hearing for Nov. 13, a spokeswoman said.

In June 1980 in Oklahoma County, Boomershine was convicted of attempted first-degree rape, indecent exposure and lewd or indecent proposals/acts to a child, documents show.

Four years earlier in Cass County, Mo., Boomershine was convicted of first-degree rape. The sentences he received on the four counts weren't immediately available.

Boomershine wasn't subject to Oklahoma's Sex Offenders Registration Act because he was convicted before the law came into effect.

The teen-ager told officers that Boomershine was drinking while she was driving his vehicle on July 25, according to an affidavit.

After the defendant told her to pull off a county road, he allegedly took her out of the vehicle, twisted her arm and placed her on the ground, documents show. There, he told her to undress and performed oral sex on her, court records claim.

She also alleged that he struck her and told her not to tell anyone, the affidavit said.
