McALESTER, Okla. (AP) -- A judge in Pittsburg County is dismissing state embezzlement charges against former McAlester City Manager Randy Green. The judge says there isn't enough evidence to try Green on charges of fraudulently ordering the transfer of more than $600,000 from McAlester's economic development account to the city's general fund.

Prosecutors say they will appeal.

Green is serving 51 months after being convicted on federal charges of improperly receiving nearly $4,580 in exchange for unused leave and vacation time.

State prosecutors say the $600,000 was used to cover the unused-leave scandal.
