OKLAHOMA CITY -- New allegations are being made against a registered sex offender accused in the murder of a Spencer woman.
Brian Bates, known throughout Oklahoma City as the Video Vigilante, took some footage of James O'Berry last fall reportedly soliciting sex from a suspected prostitute. He said he gave Oklahoma City Police the information, but nothing was done.
Bates spent most of last fall tracking O'Berry's every move.
"I've received several e-mails from people where they have said, 'Out this guy and send him back to prison, but keep your distance from him. He's a very violent man,'" Bates said.
Those e-mails came after he shot and posted the video online. It shows O'Berry allegedly in a sex act.
Bates says he told Oklahoma City Police and they failed to act.
"I'm really frustrated," said Bates. "Apparently everybody in this town knew O'Berry was a danger except the police department."
Oklahoma City Police Captain Patrick Stewart discusses the tape.
"We show no record of that tape being submitted to our agency," Stewart said.
Stewart says they only saw the tape when it was shown on local news and that the evidence was flimsy at best.
"The video showed no crime being committed that was prosecutorial in nature," Stewart said.
But his latest alleged crime is. O'Berry now stands accused of murdering 26-year-old Nelly Pelts of Spencer. Investigators say he lured Pelts away from a Walmart and murdered her in front of her church.
Bates is now making a copy of the footage he has for Midwest City Police who arrested O'Berry yesterday.
"This case concerns by the viciousness that occurred and that the fact that we have a sex predator out there preying on innocent victims," Midwest City Police Chief Brandon Clabes said.
Oklahoma City police said O'Berry was linked to a rape and a stalking case from last year. The rape case was presented to the District Attorney's office and declined. The stalking case is still pending.
Oklahoma City Police are also clearing up a false rumor about whether O'Berry was currently on parole. They said he was not. His parole ended in 1982.
