A Tulsa woman accused of pushing her husband out of the window of their 25th floor apartment has filed a wrongful death lawsuit against the apartment building and the management company, claiming they knowingly installed dangerously thin window panes.
Amber Hilberling, 20, was arrested in June 2011, after her husband, 23-year-old Joshua Hilberling, fell to his death from the window of their apartment in the University Club Tower.
The petition was filed in the Tulsa County District Court Wednesday.

The suit names University Club Tower and/or University Mansion Limited Partnership, and Horizon Realty Management, Inc., as well as two defendants referred to as John Doe 1 and 2.
In the court documents, Hilberling claims her husband tripped and fell into a wall in the living room and made contact with a large window. The court documents say the glass was not safety glass and was only one-eighth of an inch thick.

The petition claims the window glass was not up to City of Tulsa building code and was dangerously unsafe. It claims the building managers failed to install window guards or other reasonable safety measures, which should have been in place around the thin window.
Hilberling was charged with second degree murder, accused of pushing him through the window.
Her trial is set to begin on March 11, 2013.
