A group of Occupy Tulsa protesters charged with violating the city's curfew have rejected a plea agreement with the city of Tulsa and are pushing for a trial.

The group is fighting the charge following their arrests on November 2, 2011.

At the time of their arrests by Tulsa Police, several of the protestors accused police officers of using excessive force and pepper spray to clear out downtown park were they were demonstrating.

Tulsa Police Chief Chuck Jordan said officers waited more than two hours past the curfew to enforce the law.

Ollie Arbogast, the attorney for most of the protesters involved, said his clients believe their 1st amendment right was violated. They believe their Constitutional rights trump a city curfew ordinance.

The group filed a motion asking the judge to dismiss the charge. The municipal court judge set a new court date of April 5, 2012, hearing at 2 p.m.
