Homicide Charge Tossed In Lake Death

A negligent homicide charge against a Stillwater man is thrown out.  John Special's defense team claimed there just wasn't enough evidence against their client.

A negligent homicide charge against a Stillwater man is thrown out.  John Special's defense team claimed there just wasn't enough evidence against their client.  And the judge agreed.

The judge did find Special guilty of leaving the scene of an accident, a misdemeanor, punishable by a $50 fine.  Special was one of two men charged in the death of Murray McGarvey.

McGarvey died when the boat he was riding in, collided with Special's boat in 2006 on Grand Lake.

A civil case is still pending.
