SHAWNEE, Okla. (AP) -- A judge has dismissed a malpractice lawsuit filed by the father of Kelsey Smith Briggs, a 2-year-old girl who died after suffering repeated abuse. The suit named two physicians and the Shawnee Medical Center Clinic. Pottawatomie County District Judge Douglas Combs ruled Friday that the civil lawsuit filed by Lance Briggs of Shawnee had no legal standing.
Briggs filed the lawsuit in June 2006, claiming Dr. Kelli Koons and Dr. Andrea Barrett contributed to his daughter's death October 11, 2005, by failing to recognize and report she was being abused.
Koons was Kelsey's pediatrician. Barrett began treating Kelsey in April 2005 for leg fractures. Both practiced medicine at the Shawnee Medical Center Clinic when Kelsey was under their care.
