A Tulsa refinery that will benefit from a tax break for new emission controls has been out of compliance with clean air rules for more than two years.
EPA records indicate the Sinclair refinery has been in violation of Clean Air Act standards since November 2001. State officials say Sinclair has a history of faulty control systems that allow "flaring." That's a safety system burn-off of refinery products.
Sinclair says the violation is a technical matter that's being worked out.
