A Tulsa County judge has dismissed a case against a Broken Arrow man accused of raping a woman while on a date.
Daniel J. McFerron was charged with first-degree Rape and forcible sodomy. The case was dismissed on Monday at the request of the Tulsa County District Attorney.
The woman told police she'd met McFerron online and during their second date, she ordered water. She said she began to feel odd, and she remembered going to McFerron's place but said she was in and out of consciousness during the sexual assault.
Police said an initial test showed traces of a prescription medication in her system that she wasn't prescribed as well as some she was.

The district attorney dropped the charged after the second test showed essentially no trace of the drug, News On 6 was told. The district attorney's office said the victim had been given some IV fluid before the testing, but given the test difference and some other issues, the case was dropped.
McFerron had no criminal history at the time of his request.
