Steven Wade Jameson once pled guilty to manslaughter but that plea was thrown out, and he walked free. On Tuesday, Jameson was once again in court. The deadly crash happened nine years ago but prosecutors are introducing a new theory about what might've happened as the case more or less starts over.

Wade Jameson's case has been back and forth since Michael, Angela, and their son James Mulanax were killed in a crash on Christmas Eve in 2009. Jameson pleaded guilty to manslaughter, and was sentenced to 24 years in prison.

In 2015, a judge threw out Jameson's conviction and he was released, much to the dismay of the victim's family members.

"Now we have to relive their deaths all over again because this young man will not take responsibility for causing the actions that killed them," said Linda Perkins.

Six months later, the court of criminal appeals disagreed with the judge and Jameson went back to prison.

That's when the judge allowed Jameson to take back his guilty plea saying he'd received bad advice from his attorney. Now, Jameson is back in court again-starting the process all over.

This time around, prosecutors have one theory saying Jameson was driving recklessly in a blizzard when he killed the Mulanax family. Another theory the DA has is that Jameson was driving under the influence.

"I don't have any vengeance against Jameson or his family, I just want him held accountable," said Perkins.

Their family members say after nine years they're just ready to get the process going.

"I have so much belief and faith in the justice system. And that's why I continue this, because I want justice for my children's lives," said Perkins.

Jameson's attorneys say the statute of limitations has expired for a new theory to be introduced. The judge will decide next month whether or not to allow it.
