HULBERT, Oklahoma -- The Occupational Safety and Health Administration is now investigating the death of a man who died in a tractor accident on Sunday, April 17, 2011 in Cherokee County.
The Oklahoma Highway Patrol says 39-year-old Sylvester Garcia was driving a farm tractor on a private gravel road when he lost control, causing the tractor to roll and pinning him under the right wheel.

Garcia was an employee of the Tri-B Nursery on state Highway 51 near Hulbert.
OSHA spokesperson Juan Rodriguez says the agency's investigating to see if there were any OSHA violations.
OHP troopers say Garcia was driving at an "unsafe speed" at the time of the wreck.
Six other people were also on the tractor at the time, but none was injured.
Rodriguez says OSHA has six months to investigate the incident.
