TULSA, OK -- There is a new development in the case of Theo Fleming, a Tulsa high school senior charged with murder.
Fleming's attorney went to the State Court of Criminal Appeals Thursday to argue his client should not be tried as an adult in the shooting death of Kaitlyn Finnegan earlier this year.
Fleming is charged with second degree murder.

His attorney says the shooting was an accident, but police say after the gun was fired, no one called 911 and that Fleming initially lied about what happened.
It is not known when the court will make its ruling.
