MUSKOGEE, OK -- It has been a year since two Muskogee residents died at a Kansas race track.
Earlier this week, the Shawnee County DA's office said it is reviewing the case and will make a determination on whether or not to file charges in the case.
On June 1, 2008, 55-year-old Judy Brewster and 52-year-old James Jenkins were killed after attending races at the Topeka race track.
The two were walking back to their vehicles at the race track's parking lot when they were struck by a pickup truck.
Brewster died at the scene and Jenkins died at a Kansas City hospital.
The driver of the pickup truck, James Weiland of Iowa was never charged in the case.
Relatives of the two Muskogee residents have also sued the race track, but the matter remains in the courts.
