Lawsuit Filed Over Fatal Plane Crash

The families of two men killed in a March 2008 plane crash are suing the company that owned the plane and the company that chartered the flight.

OKLAHOMA CITY -- The families of two men killed in a March 2008 plane crash are suing the company that owned the plane and the company that chartered the flight.

Relatives of Garth Bates Jr. and Frank Pool Jr. filed the wrongful death lawsuit in Oklahoma County District Court. They're asking for unspecified damages from Interstate Helicopters and Southwest Orthopedics and Sports Medicine Clinic.

The lawsuit claims Interstate Helicopters wasn't certified to carry passengers for hire on the plane owned by Southwest Orthopedics and Sports Medicine Clinic.

Representatives of the companies could not be reached for comment.

Investigators have said birds caused the plane to crash and burn shortly after takeoff from Wiley Post Airport in northwest Oklahoma City and kill all five on board.
