OKLAHOMA CITY (AP) _ The state Supreme Court is refusing to remove a proposal to ban gay marriage from the November general election ballot.

The court ruled unanimously without comment Thursday not to take the case.

The decision means State Question 7-11 to put a ban on gay marriage in the state Constitution will stay on the ballot.

The American Civil Liberties Union sought to remove the proposal from the ballot saying it's vague and discriminatory.

Attorneys for the state say Oklahomans should be allowed to vote on the issue.

Though the court ruled without comment, Justice Marian Opala did explain his opinion. He wrote that without an obvious flaw in the proposal the court couldn't interrupt the people's right to make law through the initiative or referendum process.
