A first of its kind motion has been filed in Oklahoma City after a mother gave birth to a stillborn child.

Theresa Hernandez faces first-degree murder charges. Police say she gave birth to a child who was stillborn because he had twice the amount of methamphetamine in his body that it would take to kill an adult.

Oklahoma County District Attorney Wes Lane says his office has been unable to file charges in similar cases because the causes of death have not been so clear-cut.
