A judge has denied a request to delay the retrial of a Sequoyah County man accused of killing a state trooper. Kenneth Barrett is charged with the murder of Oklahoma Highway Patrol trooper "Rocky" Eales.
Eales was killed while serving a warrant on Barrett's home in 1999. Barrett's defense attorney wanted to delay the trial so he could get a complete transcript of the first trial. That trial ended in deadlocked jury.
Barrett's new trial begins January 2nd.
