(Denver-AP) -- A federal appeals court says a man sentenced to death for raping and killing an Oklahoma State University student should get a new sentencing hearing.
The appeals court says attorneys for Lloyd Mollett junior were not told that the jury wanted an explanation of life in prison, so they had no opportunity to address the confusion.
The jury that convicted Mollett in 1995 sent a note to the judge while deliberating his sentence. The jury wanted to know if Mollett could be released from prison if sentenced to life without parole.
The judge responded that parole is not something he or the jury could consider.
Mollett was convicted and sentenced to die for the 1993 rape and murder of Sri Sugeng. The Indonesian student was raped in the bedroom of her apartment, then drowned in the bathtub.
