(Oklahoma City-AP) -- The Oklahoma Criminal Court of Appeals has set an execution date for a McIntosh County man convicted of killing an elderly couple.
A July 29th execution date has been set for Harold Loyd McElmurry III. McElmurry becomes the fifth Oklahoma death row inmate to have a July execution date.
McElmurry was convicted of the 1999 murders of 75-year-old Rosa Pendley and 80-year-old Robert Pendley.
McElmurry stabbed his victims with scissors and hit them with a piece of pipe and a garden hoe.
McElmurry's direct appeal was denied December 2nd, 2002, and a rehearing was denied in February.
He has says he doesn't want to continue the appeals process and missed a May 29th deadline to file a petition asking the US Supreme Court to his case.
