(Denver-AP) -- Four Oklahoma City firefighters have lost an appeal of a lawsuit in which they claim a former chief retaliated against them because of their union activity.

The Tenth Circuit Court of Appeals decision upholds the decision of a federal judge in Oklahoma City in favor of former Chief Gary Marrs and city government.

Fire Majors Randall Lunow, Terry Weaver, Ricky Henson and Melvin Hanson junior filed the lawsuit in 2001. The four said the were denied promotions to district chief since 1994 and transferred to less desirable stations because of their activism in the local union.
